The operator of 14 chain locations commits a number of Fair Labor Act violations.
The Department of Labor obtained a preliminary court injunction against the owner of 14 Subway franchises in San Francisco, ordering him to cease the violation of multiple provisions of the Fair Labor Standards Act.
The Wage and Hour Division of San Francisco investigated the 14 locations and found the owner regularly instructed 14- and 15-year-old employees to operate dangerous equipment at illegal hours. The owner also repeatedly withheld employee wages issued hundreds of bad checks to employees, and kept tips given by customers. The division also determined that the owner attempted to undermine the investigation into his franchises multiple times.
“Federal regulations protect young workers, ensure employees are paid all their hard-earned wages, and allow workers to freely cooperate with a federal investigation without fear of retaliation by their employer,” said Alberto Raymond, the Assistant District Director of San Francisco’s Wage and Hour Division. “While learning new skills in the workforce is an important part of growing up, federal law dictates that children’s jobs must be safe and that their work doesn’t interfere with their education or well-being.”
